Filing a Medical Malpractice Claim

Just because you suffered a medical injury does not mean you have a viable malpractice claim. Serious injury or death can occur even when your doctors did everything they should have done. Malpractice occurs only if your doctor failed to meet the relevant standard of care in treating you.

If you think that you or a family member may be a victim of medical negligence, contact me for a free case evaluation. If I believe you may have a valid case, I will guide you through the steps of filing a medical malpractice claim in New Jersey. Those steps include:

  • Collecting all relevant medical records.
  • Locating an expert to conduct a thorough review of the records. This expert must be fully qualified in the same area of medicine as the defendant and be able to serve as a witness in your case.
  • Filing a lawsuit with the Court. Cases of medical malpractice are rarely resolved prior to filing a lawsuit.
  • Preparing for trial. This process can take up to two years based on the court’s calendar, but as your lawyer I will move your case forward as quickly as possible.
