One economic trend for 2020 is a major uptick in online shopping, and the retailer leading the pack is Amazon. As a result, their delivery drivers are under great pressure to deliver packages on time and to the correct address. When they fail, the company is liable for the misplaced or undelivered orders.
Last year, the company estimated they had 50,000 delivery drivers on the job for the holiday season. But you can be sure this year will exceed those numbers.
Drivers feeling the crunch
All the pressure to timely deliver the consumer goods can cause drivers to cut corners and drive recklessly. When that happens, New Jersey motorists and pedestrians are at higher risk of injury or death from collisions with the delivery trucks.
Passing the liability buck
Another problem is that many of these drivers are subcontracted and not actually employed by Amazon. This creates a murky path to recovering compensation from liable parties because while Amazon may be a mega company, the subcontractor companies may carry only the barest minimum of liability insurance.
In fact, one senior reporter with ProPublica stated that “Amazon has actually sued to enforce the terms of these agreements.”
But the pressure remains
Regardless of their hands-off liability policies, Amazon rides herd on their drivers. They employ dispatchers to call drivers and ask why certain packages have yet to arrive at their destination. This type of pressure, combined with the general stressors of driving (especially closer to the holidays), makes it even more likely for a driver to get distracted and cause a bad accident.
Certainly, the errant delivery truck driver bears a share of the liability for any accidents and injuries they cause. But it is the companies that push their drivers to accomplish impossible delivery feats that have the deep pockets.
